Terms of Service

1. The service

Onyx Delivery Hub is a software platform for managing project, programme, portfolio and PMO delivery, including plans, RAID logs, RACI matrices, scope and reporting. Onyx Digital also provides consulting and advisory services, which are agreed separately under their own scope and commercial terms.

2. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at info@onyxdigital.ro if you suspect unauthorised access.

3. Subscriptions, trials and payment

• Paid plans are billed in advance on a recurring basis (monthly, unless otherwise agreed) via our payment provider, Stripe.
• Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends, or as otherwise stated at signup.
• One-off purchases (such as the Onyx Delivery Templates Pack) are single payments for a defined digital deliverable.
• You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and no partial refunds are given for unused time unless required by law.
• Prices are shown exclusive of VAT unless stated otherwise; applicable taxes will be added at checkout where relevant.

4. Your data and content

You retain ownership of the data and content you input into Onyx Delivery Hub (plans, RAID items, documents and related information). We process this data to provide the service to you, as described in our Privacy Policy. We do not sell your data to third parties.

5. Acceptable use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to other accounts or our systems
• Reverse engineer, resell, or white-label the platform without our written agreement
• Upload malicious code or content that infringes the rights of others

6. Service availability

We aim to keep Onyx Delivery Hub available and reliable, but do not guarantee uninterrupted access. We may carry out maintenance, and features may change as the product evolves. We are not liable for losses arising from temporary unavailability of the service.

7. Consulting engagements

Any consulting, advisory or managed delivery services referenced on our website (including those under "Onyx Consulting" and "Onyx Managed Delivery") are provided under a separate scope of work, statement of work, or engagement letter agreed directly with the client, which will set out specific deliverables, timelines, fees and terms for that engagement.

8. Limitation of liability

To the extent permitted by law, Onyx Digital's total liability arising from your use of Onyx Delivery Hub is limited to the amount you paid for the service in the twelve months preceding the claim. We are not liable for indirect, incidental or consequential losses.

9. Termination

You may close your account at any time. We may suspend or terminate accounts that breach these Terms, with notice where reasonably possible.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Romania, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
